TERMS AND CONDITIONS OF ENTRY

1. About Us

Ginger Strike Competitions ("we", "us", "our") is a sole trader partnership operating from the West Midlands, United Kingdom. We run skill-based prize competitions, live raffle draws, and instant win games via our website, TikTok, and Facebook livestreams.

These Terms and Conditions ("Terms") govern entry into all competitions, raffles, and instant win games ("Competitions") run by Ginger Strike Competitions, whether entered via our website, a linked ticketing platform, or a live broadcast. By entering any Competition, you agree to be bound by these Terms.

2. Nature of Our Competitions

Our Competitions are structured as prize competitions under section 14 of the Gambling Act 2005, not as lotteries. Entry into any paid Competition requires the entrant to correctly answer a skill question before their entry is accepted. Entries that answer the skill question incorrectly will not be entered into the draw, and any payment made will be refunded or the entrant will be invited to try again, as stated on the relevant Competition page.

A free entry route is available for every paid Competition we run, in accordance with the requirement that a competition offering a free means of entry must not be structured, priced, or presented so as to make the free route materially harder to use or less likely to win. Full details of the free entry route are set out in Section 5 below.

3. Eligibility

  • You must be 18 years of age or older to enter any Competition.
  • You must be a resident of the United Kingdom, unless otherwise stated on the relevant Competition page.
  • Employees, agents, and immediate family members of Ginger Strike Competitions are not eligible to enter.
  • We reserve the right to request proof of age or identity before releasing a prize, and to withhold a prize or disqualify an entry where eligibility cannot be verified.
  • Only one account per person is permitted. Multiple accounts created to gain additional entries beyond the stated per-person limit will be disqualified.

4. How to Enter (Paid Route)

  • Select the Competition you wish to enter and choose the number of tickets/entries you wish to purchase, subject to any maximum entries per person stated on the Competition page.
  • Correctly answer the skill question presented before checkout.
  • Complete payment via the payment methods available on our site.
  • On successful payment, you will receive confirmation of your entry/ticket number(s) by email and/or in your account area.

Entries are only valid once payment has been received in full and the skill question has been answered correctly. We are not responsible for entries that fail to complete due to payment processing errors, and recommend checking your confirmation email or account area after entering.

5. Free Entry Route (No Purchase Necessary)

You do not have to pay to enter our Competitions. A free entry route is available for every Competition we run, giving you the same chance of winning as a paid entry.

5.1 How to enter for free

To enter for free, send a postcard or plain sheet of paper by first-class post, clearly stating:

  • The name of the Competition you wish to enter
  • Your full name, address, email address, and telephone number
  • Your correct answer to the skill question published on the relevant Competition page

Send your entry to: Ginger Strike Competitions, Unit K5A, Cradley Enterprise Centre Ltd, Maypole Fields, Cradley, Halesowen, West Midlands, B63 2QB.

Free entries must be received before the closing date/time of the relevant Competition. We are not responsible for entries lost, delayed, or damaged in the post. One free entry per person, per Competition, per postal item, unless otherwise stated.

5.2 Equal treatment

Free entries are allocated an entry/ticket number in exactly the same sequence and pool as paid entries, and are entered into the same draw with the same odds of winning. The maximum number of free entries permitted per person will always match the maximum number of paid entries permitted per person for that Competition.

6. Prizes

  • Prize details (including cash alternative value, where applicable) are stated on each Competition page at the time of entry.
  • Prizes are non-transferable and no cash alternative will be offered unless expressly stated, except where a prize is itself a cash prize.
  • We reserve the right to substitute a prize for one of equivalent or greater value if circumstances outside our reasonable control make this necessary.
  • Instant win competitions and prize draws follow the specific format and odds published on the relevant Competition/game page.

7. The Draw

Draws take place at the date and time stated on the relevant Competition page, and are conducted live via our TikTok and/or Facebook broadcast unless otherwise stated. Where a Competition does not sell out or reach a stated minimum number of entries by the closing date, we reserve the right to extend the closing date, or to draw from the entries received, at our discretion, as stated on the Competition page.

Winners are selected using a random number generator or equivalent random draw method applied across all valid entries (paid and free, combined) unless the Competition page states otherwise.

8. Winner Notification

  • Winners will be announced during the live broadcast and/or contacted directly using the details provided at entry, within a reasonable time of the draw taking place.
  • Winners may be asked to respond within a stated period to claim their prize. If a winner cannot be contacted or fails to claim a prize within the stated period, we reserve the right to re-draw and select an alternative winner.
  • By entering, you consent to your first name and/or username, and general location, being announced publicly as part of the live draw and any related social media posts, unless you notify us otherwise in advance.

9. Payments and Refunds

All payments are processed securely via our payment provider. We do not store your full card details. Once an entry has been accepted (correct skill question answer and successful payment), entries are final and non-refundable, except:

  • Where a Competition is cancelled or postponed by us
  • Where a technical or payment processing error has resulted in a duplicate or incorrect charge
  • Where required by applicable consumer protection law

If a Competition is cancelled for any reason, all paid entrants will be offered a full refund or, where applicable, transfer of entries to a future Competition.

10. Cancellation and Changes

We reserve the right to cancel, suspend, extend, or amend a Competition at any time where circumstances outside our reasonable control make this necessary, or where we reasonably suspect fraud, abuse, or a breach of these Terms. Where a Competition is cancelled after entries have been taken, Section 9 applies.

11. Disqualification

We reserve the right to disqualify any entry or entrant, and to withhold or reclaim a prize, where we reasonably believe there has been fraud, use of bots or automated entry methods, multiple accounts, abuse of the free entry route, or any other breach of these Terms.

12. Data Protection

We process personal data submitted as part of entry (including free postal entries) in accordance with our Privacy Notice, available at https://gingerstrike.co.uk/policies/privacy-policy, and in compliance with UK GDPR and the Data Protection Act 2018. Personal data submitted for free entries is used solely for the purpose of processing that entry and is handled with the same care as data submitted via the website.

13. Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under English law. Subject to this, our liability to you in connection with any Competition is limited to the value of your entry fee (or, for free entries, to re-entry into the draw).

14. Complaints

If you have a complaint about a Competition or its conduct, please contact us at hello@gingerstrike.co.uk in the first instance. We aim to respond to all complaints within a reasonable timeframe.

15. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
